The Data Use and Access Act (DUAA) shifts the focus from rigid compliance to responsible data use.

Companies that proactively adapt their data strategies to leverage the new flexibilities, particularly in AI and research will gain a competitive edge. Those that fail, however, to update their governance frameworks, especially regarding criminal liabilities and complaints handling, face heightened legal and reputational risks.

Many organisations invest heavily in cybersecurity tools, yet the biggest risk often lies in not knowing where their data is stored. Today we explore solutions and best practices to uncover these blind spots.

Topic:

The first DUAA provisions came into force on 19 and 20 August 2025. The next set of DUAA provisions came into force on 05 February. The last set of DUAA provisions are expected to be commenced approximately 12 months after Royal Assent. Sidsel Skovborg
Royal Danish Embassy in the UK

Sidsel

Sidsel is Digitalisation Counsellor at the Danish Embassy with a responsibility for fostering government to government cooperation on public sector digitalisation. She has a background as Head of Digital from several Danish councils as well as Lead Implementation Consultant at KOMBIT, a public owned IT company that develops and operates digital solutions for councils. Most recently Sidsel has worked as Senior Innovation Manager at DigitalLead, the Danish national cluster organisation for digital technologies.

Eleonor Duhs
Marks & Clerk

Eleonor Duhs is a partner in Marks & Clerk’s AI, data and cyber security practice. She is a barrister and the Head of Data & Privacy. Eleonor advises on all aspects of data protection law including the data protection aspects of AI.

Before working in the private sector Eleonor was a senior government lawyer. She was the government’s lead lawyer in the negotiations on the GDPR. She advised on EU and international law at the Foreign and Commonwealth Office. She also led on the core provisions of the European Union (Withdrawal) Act 2018 in the Department for Exiting the European Union as well as aspects of the EU-UK Withdrawal Agreement, and the Framework for the Future EU-UK relationship.

Eleonor has given evidence to the UK Parliament on data protection and the UK’s post-Brexit legal frameworks. She provided briefing for members of the House of Lords during the passage of the Data (Use and Access) Act 2025.

She is frequently invited to speak at international conferences and to comment on data protection and the UK’s post-Brexit legal frameworks in the media. She is currently co-authoring a second edition of her well-received book on Brexit: Retained EU Law: a Practical Guide and a book on AI regulation. She is a member of the Executive Board of the International Data Law Forum and an emeritus fellow of the International Association of Privacy Professionals. 

Eleonor has close ties to Scandinavia: she is Swedish and frequently visits her family in Stockholm. She has also lived in Oslo.
